What the law protects

Under the federal Fair Housing Act, it is illegal to discriminate in the sale, rental, or financing of housing based on:

Religion
National origin
Sex
Familial status
Disability

HUD has clarified that the Fair Housing Act's prohibition on sex discrimination also protects people from discrimination on the basis of sexual orientation and gender identity. Idaho law and many local ordinances extend additional protections. Regardless of what's written into state or local statute, we treat every client the same.

What it covers

Fair housing law applies to just about every stage of a real estate transaction, including:

  • Refusing to sell, rent, or negotiate for housing
  • Setting different terms, conditions, or privileges
  • Providing different services or facilities
  • Falsely denying that a home is available
  • "Steering" buyers toward or away from certain neighborhoods
  • Discriminatory advertising or statements
  • Denial of reasonable accommodations or modifications for people with disabilities
  • Discriminatory lending, appraisal, or insurance practices

How we put it into practice

  • We show every qualified client every home they ask about, without assumptions about where they'd "fit in."
  • We don't steer. We give you the data (pricing, inventory, neighborhood fundamentals) and you make the call.
  • Our marketing avoids language, imagery, or targeting that could exclude or discourage any protected class.
  • We work with clients who need reasonable accommodations — including service animal policies, accessible showings, and communication preferences — and we'll push back on landlords or HOAs who don't.
  • Every agent on our team is trained in fair housing law and reviewed annually.

If you believe you've been discriminated against

You have options — and you should use them. Complaints can be filed at no cost, and the following agencies will investigate on your behalf:

You generally have one year from the date of the alleged violation to file a HUD complaint. Don't wait — the sooner it's documented, the stronger the case.
